Welcome to NAZANEEN AZIZI® Styling, owned and operated by NAZANEEN AZIZI, LLC, providing personal styling & wardrobe consulting Services (refer to the Services clause below) through our website NazaneenAzizi.com (the “Site”). These Terms of Service, which also serve as our Terms of Use (the “Terms”) constitute a legally binding agreement between NAZANEEN AZIZI Styling (“NAZANEEN AZIZI Styling”, “NAZANEEN AZIZI, LLC”, “Stylist”, “us”, “we”, “our”), and you (“you”, “your”, “Client”), and govern your use of the Site and all Services offered through the Site. By accessing or using our Site and/or Services, including but not limited to personal styling Style Sync Consultations (“Consultation(s)”), style analysis & assessments, Glam Guide questionnaires, wardrobe edits, fashion-related advice, personal shopping, styling outfits, fittings, text style support, mini & full digital lookbooks, all whether in-store or virtual (collectively, such Services, including any new applications or platforms, and the Site, the “Service(s)”), you agree to comply with and be bound by the following Terms of Service and Use. If you do not agree to the Terms, you may not use the Services.
We reserve the right, in our sole discretion, to change or modify any or all of the Terms of Service and Use at any time, effective immediately upon the posting of the revised Terms of Service and Use on the Site. Your continued use of our Site or Services following the posting of updated Terms of Service and Use means you agree to any such changes.

2. Services
NAZANEEN AZIZI Styling provides comprehensive personal fashion styling Services tailored to your individual preferences and needs, offering virtual and in-store styling Services. Throughout this agreement, any mention of “virtual” or “virtually” in relation to our Services shall refer specifically to remote sessions conducted via video conferencing or phone call, and any mention of “in-person” or “in-store” in relation to our Services shall refer specifically to the Designated In-Person Shopping Locations clause below.
We are dedicated to helping you discover your unique style and curate a wardrobe that reflects your personality and lifestyle. Our Services include, but are not limited to: personal style Style Sync Consultations (“Consultation(s)”), style analysis & assessments, Glam Guide questionnaires, wardrobe edits, fashion-related advice, personal shopping, styling outfits, fittings, text style support, mini & full digital lookbooks. These Services may be provided in-store or virtually, depending on your preferences and needs. Our platform also provides educational resources, shopping & style tips, to empower you to make confident fashion choices.
NAZANEEN AZIZI Styling begins a Service by completing a complimentary virtual 30-minute Style Sync Consultation with the Client, and the Client answers questions, including but not limited to questions listed in the Glam Guide questionnaire, to help the Stylist understand the Client’s style goals, preferences, lifestyle, and budget. The Stylist uses questions and discussions to analyze and assess the Client’s personal style, and offers a Service that best addresses the Client’s needs. At the time of the Stylist performing Services upon the Client’s request, the Stylist may suggest clothes and accessories (“clothes”, “clothing”, “accessories”, “pieces”, “items”, “wardrobe”) for the Client, in intermittent intervals, based on their discussed preferences and style goals. The Client may choose which clothing and accessory items they would like to purchase themselves, with no obligation to make any particular purchases. Depending on the Service the Client purchases, the Stylist may also have the Client try on clothes from their closet, helping the Client make decisions on which clothing and accessories to keep, tailor, or remove from the wardrobe based on style goals discussed, as well as provide styling advice. The Stylist may also have the Client try on new clothes the Client purchased based on the Stylist’s recommendations, and help the Client make decisions on which clothing and accessories to keep, tailor, or return, based on style goals discussed.
The Client acknowledges and agrees that all Services provided by NAZANEEN AZIZI Styling have a deadline, and it is the Client’s responsibility to schedule and complete all sessions within the specified time frame and by deadline set by the Stylist (refer to Duration of Service clause below).
It is important to understand that NAZANEEN AZIZI Styling does not provide any kind of professional counseling, therapy, career, personal relationship, or medical advice. Our Services are intended solely for educational and informational purposes related to fashion and style development. We do not provide professional, trained, or certified image consulting Services, color palette analysis or body type analysis. We do not provide in-home styling Services.
You acknowledge and agree that your achievements and success are your own responsibility, and the Stylist cannot guarantee or promise that you will undertake any particular action or achieve specific goals (refer to Disclaimer of Warranties and Guarantee clause below).
Please note that all Services are provided subject to availability and at the sole discretion of NAZANEEN AZIZI Styling. By engaging our Services, the Client acknowledges and agrees to the Terms outlined herein and understands that NAZANEEN AZIZI Styling strives to deliver a satisfying styling experience.
3. Designated In-Person Shopping Locations
For in-person shopping Services, NAZANEEN AZIZI Styling reserves the sole discretion to select the optimal shopping location from the designated list of in-person shopping locations below. This selection is based on factors including the mall’s store directory, as well as the Client’s style goals, needs, and preferences.
The Client must consent to meet the Stylist at one or more of the following locations at a mutually agreed upon time. However, it is important to note that the Stylist assumes no liability or responsibility for any insufficient or lack of preferred clothing and accessory inventory store selection. In the event that suitable clothing and accessories aligned with the Client’s style goals, needs, and preferences are not available, the Stylist cannot be held accountable.
The Client acknowledges and agrees that while the Stylist strives to achieve a successful shopping outcome, there is no guarantee of it. Clients should refer to the respective shopping location’s website to obtain contact information, as well as details regarding hours of operation, and parking arrangements.

For the “in-person” or “in-store” shopping Services, a “day” is defined as a maximum of 6 hours per day. Depending on the outcome or result of the shopping Service, the Client may need to purchase additional shopping Services if they desire further in-store shopping beyond the initially allocated hours included in their Service package. This additional purchase may be necessary even if the dissatisfaction with the initial shopping session is not attributed to any fault of the Stylist and is due to factors beyond their control, such as wardrobe inventory availability. The Stylist may complete the shopping session in less than the full 6-hour duration if deemed sufficient to meet the Client’s shopping needs for the specific Service purchased. The Stylist is not obliged to perform a full 6 hours of shopping if it is unnecessary. The decision to break the allocated hours into multiple days is at the discretion of the Stylist, but it is not a requirement.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to the Terms outlined in this clause regarding Designated In-Person Shopping. We are committed to delivering quality styling Services and striving to meet your in-person shopping and styling needs effectively.
4. Client Responsibilities
As a Client of NAZANEEN AZIZI Styling, you agree to fulfill the following responsibilities:
- Communication and Cooperation: The Client will promptly communicate preferences, provide feedback, and notify of any changes impacting the Services promptly. Cooperation with the Stylist, adherence to appointment schedules, and compliance with payment Terms and policies outlined in these Terms of Service are essential. The Client commits to paying upfront and adhering to all payment policies, cancellation fees, and rescheduling policies outlined in these Terms of Service.
- Respectful Behavior: The Client must maintain respectful and professional conduct at all times, whether in-person, via text, phone call, video conferencing, and so forth. Any abusive or inappropriate behavior may result in suspension, termination, or refusal of Service, by the Stylist at any time and, for any reason with or without notice. The Stylist reserves the right to not provide a refund in such circumstances.
- Commitment and Understanding: The Client must demonstrate patience, understanding, and commitment to the styling process. Acknowledgment that the success of the outcome depends on the Client’s cooperation and commitment is essential.
- Dealing with Third-Party Companies: The Client agrees to handle interactions with third-party companies independently, including returns, exchanges, and payment plan arrangements, relieving NAZANEEN AZIZI Styling of any involvement or responsibility.
- Appointment Management: The Client is responsible for scheduling and keeping track of all sessions and appointments to ensure completion within the designated time frame and respective Service package deadline. Punctuality and giving at least 24-hour notice for rescheduling appointments are required.
- Preparation and Reliability: The Client must read instructions beforehand, prepare for appointments and sessions, provide reasonable lighting in photos, videos, and live video conferencing appointments, and maintain reliable communication with the Stylist throughout the process to aim for a smooth and successful outcome. The Client agrees to cooperate with the Stylist and provide all necessary information promptly and accurately. This includes responding to inquiries, being on time to scheduled appointments, completing the Glam Guide questionnaire, and being responsive via text, phone, and email.
- Financial Responsibilities: The Client acknowledges and agrees that any texting charges incurred and expenses related to virtual or in-person Services, including equipment such as laptop, computer, mobile devices, as well as internet and WiFi access, clothing purchases and returns, alterations, transportation, parking, and associated costs, are the sole responsibility of the Client.
- Waiver of Claims: The Client waives and releases any claims arising from personal or challenging questions posed by the Stylist during the Services, including but not limited to sensitivity regarding skin tone, body type, size, gender, or any aspect of their appearance or feelings related to styling. This waiver excludes conduct or actions outside the scope of the styling Services. NAZANEEN AZIZI Styling is committed to providing inclusive and respectful styling Services to all Clients. In the event that NAZANEEN AZIZI Styling determines, at its sole discretion, that it is unable to provide styling Services to a Client due to reasons such as lack of expertise, experience, confidence, availability, or compatibility, including but not limited to considerations related to gender identity, body type, or any other personal characteristic or feelings related to styling, the Client agrees not to hold NAZANEEN AZIZI Styling responsible or liable for such refusal. NAZANEEN AZIZI Styling respects and values diversity and endeavors to provide a safe and inclusive environment for all Clients. The Client acknowledges and agrees that NAZANEEN AZIZI Styling shall not be subject to any claims of discrimination or defamation arising from such refusal, and hereby releases NAZANEEN AZIZI Styling from any such claims.
- Informed Decision-Making: The Client agrees to exercise due diligence and discretion when making in-store and online purchases, including but not limited to reviewing product descriptions, size charts, and customer reviews. The Client understands that they bear full responsibility for assessing the suitability and quality of any clothing items purchased in-store and online (refer to Clothing Purchases and Returns clause below).
- Food and Beverage Disclaimer: NAZANEEN AZIZI Styling may, as a courtesy, provide food, snacks, refreshments, beverages, including alcohol, during the provision of Services. The Client acknowledges and agrees that they consume these offerings at their own risk. NAZANEEN AZIZI Styling shall not be held liable or responsible for any food allergies, intolerances, religious or personal dietary restrictions, or adverse health reactions resulting from the consumption of these items. It is the Client’s responsibility to monitor their own dietary intake and make informed decisions about what they choose to eat or drink. The Client understands that they are under no obligation to consume any offerings provided and do so at their own discretion. NAZANEEN AZIZI Styling shall not be held liable for any negative health outcomes experienced by the Client as a result of consuming provided food or beverages.
By engaging NAZANEEN AZIZI Styling’s Services, the Client affirms their understanding and acceptance of these responsibilities.
5. Payments, Plans, and Billing
All payments are due up front, and all Service sales are final. Within 24-48 hours after your complimentary, virtual 30-minute Style Sync Consultation, you will receive a quote outlining the Service details including costs, where you must make the payment and agree to the Terms before we officially begin working on your Service.
All payments for NAZANEEN AZIZI Styling’s Services shall be made using our third-party designated electronic payment provider, Stripe (“Stripe”). By agreeing to these Terms of Service, you authorize NAZANEEN AZIZI Styling to charge your designated payment method through Stripe for the total amount due for the Services rendered. You understand and acknowledge that Stripe’s terms of service and privacy policy govern your use of their payment processing services, and NAZANEEN AZIZI Styling shall not be liable for any issues, disputes, or losses arising from your use of Stripe’s services. It is your responsibility to ensure that the payment information provided is accurate and up-to-date. In the event of any payment disputes or discrepancies, you agree to contact the appropriate business directly for resolution.
NAZANEEN AZIZI Styling may, at its sole discretion, offer Clients the option to utilize third-party payment plan providers for the payment of our Services. In such instances, NAZANEEN AZIZI Styling is not liable or responsible for any issues that may arise between the Client and the third-party payment plan provider. The Client acknowledges that NAZANEEN AZIZI Styling is not their point of contact for any matters related to the terms, conditions, or performance of the payment plan offered by the third-party provider. Any disputes, grievances, or concerns regarding the payment plan must be addressed directly with the third-party provider, and NAZANEEN AZIZI Styling shall not be held accountable for any consequences resulting from the Client’s engagement with the third-party payment plan provider. Exact payment plan details vary, as it’s controlled and offered by third-party payment plan providers, and exact details can only be reviewed at the time of receiving the quote via Stripe prior to the start of the project.
We currently only work with Clients 18 years of age and older in the United States, and accept U.S. currency through credit and debit cards, assuming it is accepted by Stripe. We do not accept cash payments. We currently do not work with international Clients or accept international currency. By agreeing to these Terms of service, you affirm that you are located within the United States, and are 18 years of age or older. Furthermore, you agree to make payment for the Services rendered in U.S. currency accepted through Stripe.
6. Referral Credit
NAZANEEN AZIZI Styling is pleased to offer referral credit to our Clients as a token of appreciation for your support. The following points outline the Terms and conditions regarding referral credits:
- Eligibility: To qualify for referral credit, you must refer a new Client to NAZANEEN AZIZI Styling. The referred Client must make a payment to proceed with one of our Services, providing your full name at the time of Consultation.
- Discount Application: Upon successful referral, you will receive a discount on your next project with NAZANEEN AZIZI Styling. Please note that referral credits do not apply to full digital lookbook add-ons.
- Credit Notation: Referral credits will be duly noted on your account for future reference.
- Referred Client Responsibility: It is the responsibility of the referred Client to provide your full name during the Consultation meeting to ensure proper crediting of your account for the referral credit. The referral credit will only be applied if the referred Client makes a payment to proceed with one of our qualifying Services.
- Expiration: Referral credits do not have a monetary value and expire one year from the date the referred Client provides your name.
- Applicable Services: Referral credits apply as follows for the listed Services:
- $700 off of virtual Let’s Be Friends & $850 off of hybrid
- $400 off of virtual Out With the Old, in With the New & $550 off of hybrid
- $150 off of virtual Get My Chic Together
- $200 off of virtual Make a Statement tier 1 & $350 off of hybrid
- $250 off of virtual Make a Statement tier 2 & $400 off of hybrid
- $300 off of virtual Make a Statement tier 3 & $450 off of hybrid
- $350 off of virtual Make a Statement tier 4 & $500 off of hybrid
- $260 off of virtual Retail Therapy & $410 off of hybrid

By participating in our referral program, you acknowledge and agree to these Terms governing referral credits. We appreciate your continued support and look forward to serving you and your referrals with exceptional styling Services.
7. Refunds and Client Service Support Guarantee
At NAZANEEN AZIZI Styling, we uphold a strict policy that all Service sales are final, and we do not offer refunds under any circumstance. However, we are committed to working diligently to address your needs & concerns, providing top quality styling Services. To this end, for Clients to feel confident in their purchases, we stand by our Client Service Support Guarantee, meaning we offer infinite, complimentary modifications and edits to Service packages as needed, within the scope of the Service purchased.
It is important to note that Clients cannot carry over, save, or transfer any unused time for later use in their Service package. We offer ample time within each Service package to accommodate your styling needs. Our aim is to complete the Service package efficiently within the allotted time frame, ensuring optimal Service delivery.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to the Terms outlined in this clause regarding refunds and our Client Service Support Guarantee. We are committed to delivering quality styling Services and providing ongoing support to meet your styling needs effectively.
8. Cancellation Fees, and Rescheduling
NAZANEEN AZIZI Styling understands that unforeseen circumstances may arise, necessitating changes to scheduled appointments. To accommodate such situations, we have established the following policies regarding cancellation fees and rescheduling. We do not allow cancellations once an appointment has been scheduled. However, we recognize that unexpected events may occur, and we permit rescheduling of appointments. If you need to reschedule your appointment, you must provide at least 24 hours’ notice. It is your responsibility to arrange for the rescheduling of the appointment.
Please note, you are still required to schedule and complete all sessions within the designated time frame, and by the deadline of the Service package you purchased. Failure to provide at least 24 hours’ notice for rescheduling or failure to attend a scheduled appointment for any reason may result in a fee of up to $250 at our sole discretion, charged for each missed appointment.
If you choose to cancel your Service for any reason, you will not be entitled to a refund. Our styling Services involve a significant time commitment, and we strive to deliver a quality Client experience. We value and respect your time and expect the same in return.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to abide by the cancellation fees and rescheduling policies outlined in this clause. We appreciate your understanding and cooperation in adhering to these policies to ensure the smooth delivery of our styling Services.
9. Clothing Purchase and Returns
At NAZANEEN AZIZI Styling, our pricing structure is designed to cover the cost of our styling Services exclusively. Please note the following regarding clothing purchases and returns.
- Exclusion of Clothing Costs: Our prices are solely intended to compensate for the styling Services provided by NAZANEEN AZIZI Styling and do not encompass the expenses associated with clothing purchases made during our shopping Service.
- Third-Party Company Policies: Clients are required to adhere to the terms and conditions set forth by third-party companies from which clothing is purchased. This includes compliance with the respective company’s return and exchange policy. NAZANEEN AZIZI Styling bears no responsibility or liability in this regard.
- Fit Guarantee: In instances where clothing is purchased online or in-person based on the Stylist’s recommendations, it is important to note that NAZANEEN AZIZI Styling cannot guarantee the accuracy of the fit. Clients are advised to exercise patience and prudence and assume responsibility for any returns or exchanges within the company’s designated return and exchange policy.
- Online Purchases: It is the sole responsibility of the Client to understand and accept that NAZANEEN AZIZI Styling assumes no liability or responsibility for online purchases made based on the Stylist’s recommendations. The Client understands that NAZANEEN AZIZI Styling cannot guarantee that the purchased clothing will fit well, accurately resemble its appearance online, or possess the expected quality of material, among other factors.
- Assumption of Risk: The Client acknowledges that any decisions made to purchase clothing items online or in-person based on the Stylist’s guidance are made at their own risk. NAZANEEN AZIZI Styling shall not be held liable or responsible for any dissatisfaction, discrepancies, or adverse outcomes resulting from such purchases.
- Communication: It is the Client’s responsibility to promptly communicate any concerns or issues regarding online or in-person purchases to NAZANEEN AZIZI Styling. While the Stylist strives to provide guidance and assistance, ultimate responsibility for the outcome of online or in-person purchases rests with the Client.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to these Terms and conditions regarding clothing purchases and returns. We appreciate your understanding and cooperation in adhering to these policies for a smooth and satisfactory styling experience.
10. Client Text Style Support
If your Service package includes text style support, please note the following Terms and conditions:
- Commencement of Service: Text style support service commences on the same date as your final virtual or in-store session, marking the conclusion of the Service. Following this point, the Stylist will not engage in in-store meetings, virtual sessions, or phone calls with the Client until a new Service purchase has been made. The Client acknowledges and agrees that any texting charges incurred and expenses related to virtual or in-person Services, including equipment such as laptop, computer, mobile devices, as well as internet and WiFi access, and associated costs, are the sole responsibility of the Client.
- Scope of Service: Text style support enables Clients to ask the Stylist simple, quick styling questions exclusively through text messages, within the scope of the Service purchased. This Service is intended to address any follow-up or lingering questions the Client may have upon completing the purchased Service.
- Eligibility: Text style support is exclusively offered to existing Clients who have purchased Service packages that include this feature, within the specified time frame outlined in the respective Service package (refer to Services on the Site).
- Service Hours: Client text style support operates during the following business hours: Monday through Friday, from 10:00 am to 6:00 pm Pacific Time. Clients are advised to allow 1 business day for a response. In accordance with our commitment to responsive communication, we endeavor to address inquiries and concerns within 1 business day; however, in the event that a response cannot be provided within this timeframe due to unforeseen circumstances or high volume, we pledge to reply as promptly as possible thereafter. Please understand that any delay in response does not constitute liability on the part of NAZANEEN AZIZI Styling for any resulting consequences.
- Limitations: The Stylist reserves the right to refuse to answer any and all texts that exceed the scope of the package/Service Terms, require a phone or video call, or are deemed unprofessional or unnecessary. Additionally, the Stylist retains the right to cancel, in full or in part, at its sole discretion with or without notice, the client’s text style support service at any time, particularly in instances where the service is being abused or misused.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to adhere to the Terms and conditions outlined in this clause regarding Client text style support. We appreciate your understanding and cooperation in utilizing this Service effectively for your styling inquiries.
11. Digital Lookbooks
If your Service package includes a mini or full digital lookbook, or if you have purchased any of these Services as an add-on to your Service package, upon completion of the Service, the Client will receive a digital version of outfits styled specifically for them.
- Mini Digital Lookbook: A mini digital lookbook may consist of up to 5 outfits maximum, styled with clothing and accessories purchased by the Client based on the Stylist’s shopping suggestions, and may only include more outfits at an additional cost (refer to Services on the Site).
- Full Digital Lookbook: A full digital lookbook entails styling various outfit combinations using the Client’s existing wardrobe. The number of outfits styled in a full digital lookbook is unspecified and may vary depending on the number of clothing items in the Client’s closet. Pricing details for full digital lookbooks can be found on the NAZANEEN AZIZI Styling Site.
- Number of Outfits Guarantee: Please note that we cannot guarantee a specific number of outfit combinations styled for you in either the mini or full digital lookbook. The number of outfits may vary based on factors such as wardrobe inventory and styling preferences.
- Submission Deadline: It is imperative that the Client submits the necessary photos by following the instructions provided to them thoroughly and accurately, within the designated time frame and deadline specified on the NAZANEEN AZIZI Styling Site. Failure to do so may result in low quality digital lookbook photos, delays in the delivery of the digital lookbook, or termination of the Service with no refund at NAZANEEN AZIZI Styling’s sole discretion.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to the terms outlined in this clause regarding digital lookbooks. We are committed to delivering quality lookbooks to enhance your outfits for you in a convenient manner through the power of styling.
12. Service and Pricing Modification
NAZANEEN AZIZI Styling reserves the right to change or modify any Service offered to the Client, refuse or suspend Service, either in part or in full, permanently or temporarily, at our sole discretion and without prior notice to Client, for any reason. Upon Service suspension or termination, the Client shall cease all use of the Services and any associated materials or content.
In the event that you request a change in the scope of the Services initially purchased, you will be provided with a new quote reflecting the additional Services requested. Payment for the new Services must be made upfront before NAZANEEN AZIZI Styling commences work on the modified Services.
NAZANEEN AZIZI Styling retains the right to adjust prices at our sole discretion. If you do not proceed with your Service upon receiving the initial quote and our prices have changed thereafter, the original quote will become obsolete. A new quote reflecting the updated price will need to be generated for your consideration and payment.
By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the Service and pricing modification policies set forth in this clause.
13. Duration of Service
NAZANEEN AZIZI Styling outlines the duration of Service as follows:
- Completion Within Specified Timeframe: The Client is responsible for completing their Service package within the timeframe specified under each Service package on the NAZANEEN AZIZI Styling Site. While reminder texts or emails may be sent if the Client opts for such notifications and if the Stylist provides the notifications, it remains the Client’s ultimate responsibility to manage appointments and ensure all sessions are scheduled before they expire on the respective deadline.
- Appointment Scheduling Deadline: Following the Consultation and payment for all Services except for the one-time, 60-minute Give It to Me Straight Service, the Client must schedule their first appointment within 6 months of the Consultation. The Give It to Me Straight Service requires the Client to schedule their one-time appointment within 3 weeks of the Consultation. Failure to schedule appointments within the required deadlines may result in a cancellation fee of up to $250 for each missed appointment or termination of the Service without refunds, at the sole discretion of NAZANEEN AZIZI Styling. Communication with the Stylist throughout the Service package duration is essential.
- Extensions at Stylist’s Discretion: NAZANEEN AZIZI Styling reserves the right, at its sole discretion, to provide extensions to a Client’s Service package when deemed reasonable and confirmed with the Client. However, NAZANEEN AZIZI Styling is not obligated to grant extensions for any reason.
- Deadline Adjustment: Upon completion of the first session, the respective deadline specified for the purchased Service package on the Site applies. Any alternative deadlines must be approved by the Stylist. The Client must remain responsive to texts, calls, and emails from NAZANEEN AZIZI Styling between sessions after the first session is complete. Failure to do so may result in fees of up to $250 for each missed appointment, late cancellation, or multiple reschedules that exceed the Service deadline. NAZANEEN AZIZI Styling reserves the right to deny extensions to the Service and suspend or terminate the Service at any time, with or without notice, at its sole discretion.
By engaging NAZANEEN AZIZI Styling’s Services, you acknowledge and agree to adhere to the Terms outlined in this clause regarding the duration of Service. We appreciate your understanding and cooperation in ensuring a smooth and successful styling experience.
14. Disclaimer of Warranties, Guarantee, and Certification
You affirm that your achievements and success are your own responsibility, and the Stylist cannot guarantee that you will take any particular action or achieve specific goals. NAZANEEN AZIZI Styling does not offer any form of guarantee or warranty that the Services, products, or results thereof will meet all of your or any other individual’s objectives or needs, or achieve any specific desired outcome. You acknowledge that past outcomes are not indicative of future results. Therefore, the outcome experienced by others, including Clients of NAZANEEN AZIZI Styling or otherwise, who apply the principles outlined in your project, do not ensure that you or any other individual or entity will achieve similar results.
NAZANEEN AZIZI Styling acknowledges that its Stylists are not certified or trained professionals in image consulting, color palette analysis, or body type analysis. The Services provided do not include formal image consulting Services or certified analysis of color palettes or body types. Clients understand and agree that any advice or recommendations provided by NAZANEEN AZIZI Styling regarding color palettes, body types, or image consulting are based on the Stylist’s personal expertise and experience in the fashion industry, rather than formal certification or training in these specific areas.
The Services provided by NAZANEEN AZIZI Styling, along with all content, products, and Services accessible through the Services, are presented “as is” and “as available,” unless explicitly stated otherwise in writing. NAZANEEN AZIZI Styling does not offer any warranties, whether expressed or implied, regarding the operation of the Services or any content, products, or Services available through the Services, unless explicitly stated otherwise in writing. These warranties include, but are not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and accuracy. You acknowledge that your utilization of the Services and any products acquired through them is solely at your own risk. We do not guarantee or make any warranty that the Products or Services will fulfill your requirements, or that the Services will be uninterrupted, timely, secure, or free from errors. Additionally, we do not guarantee or make warranty as to the outcome from the use of our products or Services, or that any defects in the Products or Services will be rectified. Any oral or written advice or information received from us through the Services, or otherwise, does not create any warranty, representation, or guarantee beyond what is expressly stated in these Terms of Service.
By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the disclaimer of warranties, guarantee and certification set forth in this clause.
15. Allocation of Risk
NAZANEEN AZIZI Styling acknowledges that certain risks may be associated with the provision of virtual and in-store styling Services. By engaging with our Services, the Client agrees to assume certain risks, including but not limited to:
- Risks associated with the accuracy, completeness, or timeliness of styling recommendations provided by NAZANEEN AZIZI Styling.
- Risks related to the Client’s satisfaction with the styling Services rendered, including the suitability of recommended clothing items and accessories.
- Risks associated with the Client’s decisions to purchase clothing items or accessories based on the NAZANEEN AZIZI Styling’s recommendations.
- Risks related to the Client’s use of any educational resources or advice provided by the NAZANEEN AZIZI Styling.
- The Client acknowledges and accepts these risks and agrees that NAZANEEN AZIZI Styling shall not be held liable for any damages or losses arising from them.
By engaging with NAZANEEN AZIZI Styling’s virtual and in-store styling Services, the Client acknowledges and agrees to the allocation of risk set forth in this clause.
16. Limitation of Liability
By agreeing to these Terms, the Client acknowledges and agrees that NAZANEEN AZIZI Styling and its Stylists shall not be held liable for any injuries, accidents, or damages that may occur during in-store or virtual styling sessions, whether due to the Client’s actions or otherwise. The Client agrees not to hold NAZANEEN AZIZI Styling responsible for any accidents, injuries, or damages that may occur, even if the Client believes it was a result of the Stylist’s suggestions or instructions.
Limitation of Liability: To the fullest extent permitted by applicable law, in no event shall NAZANEEN AZIZI Styling, its directors, third-party Service providers, officers, employees, affiliates, or agents be liable to the Client or any person or entity associated with the Client for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever arising out of or in any way related to the provision of virtual and in-store styling Services, including but not limited to:
- Loss of profits, revenue, or data.
- Loss of use or inability to use the styling Services.
- Cost of procurement of substitute goods or Services.
- Any unauthorized access to or alteration of the Client’s transmissions or data.
- Any other matter relating to the styling Services provided by NAZANEEN AZIZI Styling, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if NAZANEEN AZIZI Styling has been advised of the possibility of such damages.
- The Client agrees that the total liability of NAZANEEN AZIZI Styling, its directors, officers, employees, affiliates, and agents arising out of or related to the provision of styling Services shall not exceed the amount paid by the Client to NAZANEEN AZIZI Styling for the specific styling Services giving rise to the liability.
NAZANEEN AZIZI Styling does not warrant or guarantee the dependability, suitability, punctuality, accuracy, or availability of the information, third-party Service providers, and fashion, styling, and wardrobe related products utilized during the provision of any of our Services. By using our platform, you acknowledge and accept that NAZANEEN AZIZI Styling assumes no responsibility or liability for any inaccuracies, errors, or omissions in the information provided. Our liability is limited to the extent permitted by law, and we shall not be held accountable for any damages or losses resulting from your reliance on our Services.
In certain jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted by law, the limitations of liability set forth herein may not apply to you. If you are dissatisfied with any aspect of the Services provided by NAZANEEN AZIZI Styling or with any of the Terms outlined in this agreement, your sole and exclusive remedy is to discontinue your use of the Site.
Indemnification: The Client agrees to indemnify, defend, and hold harmless NAZANEEN AZIZI Styling, its directors, third-party Service providers, officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including but not limited to reasonable attorney’s fees, arising out of or in connection with:
- Any breach of the Terms and conditions of this agreement by the Client.
- Any violation of applicable laws, regulations, or third-party rights by the Client.
- Any use of the virtual and in-store styling Services provided by NAZANEEN AZIZI Styling by the Client or any third party acting on behalf of the Client.
- Any content, data, or information provided by the Client that infringes upon the intellectual property rights or other rights of any third party.
- Bodily injury, death of any person, or damage to real or tangible, personal property resulting from the negligent or willful acts omissions of Client
- Client’s breach of any representation, warranty, or obligation of Client in these Terms.
By engaging with NAZANEEN AZIZI Styling’s virtual and in-store styling Services, the Client acknowledges and agrees to the Terms outlined in this limitation of liability and Indemnification clause, including the obligation to indemnify NAZANEEN AZIZI Styling for any claims or liabilities arising out of the Client’s use of the Services.
17. Dispute Resolution and Arbitration
By utilizing the Services provided by NAZANEEN AZIZI Styling and entering into any contracts with NAZANEEN AZIZI Styling, you hereby waive all present and future claims related to NAZANEEN AZIZI Styling, its Services, and products. In the event of any dispute arising from or relating in any way to Client’s purchase of Services from NAZANEEN AZIZI Styling, including any claim or controversy, whether in contract, tort or otherwise, whether past, present or future, and including statutory, consumer protection, common law, intentional tort, injunctive and equitable claims, you agree to pursue resolution exclusively through binding arbitration conducted solely in Los Angeles, California in accordance with the Rules of Arbitration of the American Arbitration Association applying California law, by a single arbitrator appointed in accordance with said Rules. The language of the arbitration shall be English. You further waive any right to class arbitration and agree that arbitration shall be limited to individual specific claims asserted by you or any related entity against NAZANEEN AZIZI Styling.
To the extent permitted by law, you agree to bear all costs and expenses associated with initiating and administering arbitration, including but not limited to reasonable attorney’s fees. By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the dispute resolution and arbitration policies set forth in this clause.
18. Governing Laws
Any disputes arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of Los Angeles, California, without regard to its conflict of law provisions.This agreement constitutes the entire agreement of NAZANEEN AZIZI Styling and the Client, and no amendment or modification of the agreement shall be valid, unless in writing and signed by both NAZANEEN AZIZI Styling and the Client. By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the governing laws set forth in this clause.
19. Severability
If any part of these Terms are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in full effect.
20. Intellectual Property
All content provided by NAZANEEN AZIZI Styling, including but not limited to fashion and styling recommendations, outfit suggestions, style guides, shopping and styling strategies, digital lookbooks, photos, videos, written materials, instructions, e-books, newsletters, magazines, blogs, emails, texts, video calls, phone calls, and digital products, are the intellectual property of NAZANEEN AZIZI Styling, and may not be publicly displayed, reproduced, distributed, or otherwise exploited without prior written consent.
The Client acknowledges and agrees that all intellectual property rights associated with the Services, including but not limited to trademarks, service marks, trade names, designs, logos, patents, copyrights, manuals, how-to’s, instructions, protective creative and design works, creative and design elements, illustrations, presentation materials patents, domain names, product names, catalogs, presentations, styling materials, brochures, or any other creative, design, and proprietary information, belong solely and exclusively to NAZANEEN AZIZI Styling.
The Client agrees not to adapt, reproduce, distribute, modify, publicly display, create derivative works, or otherwise exploit any intellectual property belonging to NAZANEEN AZIZI Styling based on the Services without prior written consent from NAZANEEN AZIZI Styling. Nothing in this agreement grants the Client any rights to use any intellectual property belonging to NAZANEEN AZIZI Styling without prior written consent.
NAZANEEN AZIZI Styling’s Site is subject to the ownership or license rights of NAZANEEN AZIZI Styling, and any manufacturers or suppliers. Unless otherwise agreed in writing with NAZANEEN AZIZI Styling, the Client shall have no right to copy, reproduce, modify, publish, upload, transmit, distribute in any way, create derivatives of, or otherwise exploit any of the intellectual property of NAZANEEN AZIZI Styling or any manufacturer or suppliers without NAZANEEN AZIZI Styling’s prior written consent.
The Client retains ownership of any content, materials, or information provided to NAZANEEN AZIZI Styling for the purpose of receiving Services. However, by providing such content to NAZANEEN AZIZI Styling, the Client grants NAZANEEN AZIZI Styling a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content solely for the purpose of providing Services to the Client.
In the event that the Client becomes aware of any unauthorized use or infringement of NAZANEEN AZIZI Styling’s intellectual property rights, the Client shall promptly notify NAZANEEN AZIZI Styling and cooperate in any efforts to enforce such rights. The provisions of this clause shall survive the termination or expiration of this agreement. By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the intellectual property policies set forth in this clause.
21. Intended Use and Prohibited Activities
The Client agrees to use the Services solely for their intended purpose of receiving virtual and in-store styling consultations and recommendations. The Client shall not use the Services for any unlawful or unauthorized purpose, including but not limited to transmitting any harmful or objectionable content, engaging in fraudulent activities, or violating the rights of others.
22. Confidentiality
NAZANEEN AZIZI Styling acknowledges that during the course of providing styling Services to the Client, sensitive information may be shared. NAZANEEN AZIZI Styling agrees to maintain the confidentiality of all such information and not to disclose it to any third party without the prior written consent of the Client, except as required by law. With that, the Client acknowledges that certain communication methods, such as wireless telephones and email, may not offer complete security against interception.
Client agrees to keep NAZANEEN AZIZI Styling’s personal information confidential, including but not limited to phone number, home or work address, financial information, schedules, and any additional sensitive information shared with the Client during the provision of Services, unless required by law. Further, Client agrees to keep NAZANEEN AZIZI Styling’s proprietary information confidential, including all unique styling methods and processes, unless receiving prior written consent.
NAZANEEN AZIZI Styling shall take reasonable measures to safeguard the privacy and confidentiality of the Client’s information. This includes implementing appropriate security measures to prevent unauthorized access, disclosure, or use of the Client’s information. Confidentiality obligations shall not apply to information that: (a) was already in the public domain at the time of disclosure; (b) becomes publicly available through no fault of NAZANEEN AZIZI Styling; (c) is independently developed by NAZANEEN AZIZI Styling without reference to the Client’s information; or (d) is required to be disclosed by law, regulation, or court order.
NAZANEEN AZIZI Styling may use information obtained during the provision of Services for marketing or promotional purposes, including the online Site, and social media platforms. However, NAZANEEN AZIZI Styling shall not disclose the Client’s personal name or reveal their identity, home or work address, phone number, or any other personally identifiable information without the explicit consent of the Client.
NAZANEEN AZIZI Styling may seek the Client’s consent to use their information for specific purposes, such as testimonials or reviews. In such cases, NAZANEEN AZIZI Styling shall obtain the Client’s explicit consent before using their information in any promotional materials.
The provisions of this clause shall survive the termination or expiration of this agreement.
23. Force Majeure
NAZANEEN AZIZI Styling will not be liable for delays in delivery or for failure to perform its obligations due to causes beyond its reasonable control, including, but not limited to, material shortages, labor disputes, transportation delays, unforeseen circumstances, emergencies, illnesses, death, acts of God, acts or omissions of other parties, acts or omissions of civil or military authorities, government priorities, fire, strikes, floods, power outages, severe weather conditions, computer interruptions, terrorism, epidemics and pandemics, quarantine or other governmental restrictions, riots, or war. Stylist’s time for delivery or performance will be extended by the period of such delay, or Stylist, at its option, may reschedule or cancel any Service or remaining part thereof, without liability, by giving notice to Client. By engaging NAZANEEN AZIZI Styling’s Services, the Client acknowledges and agrees to the force majeure set forth in this clause.
